Welcome to KITOYA. These Terms of Service ("Terms") govern your access to and use of the Kitoya mobile application, available on the Apple App Store and Google Play Store (the "Service"), operated by an individual based in France. By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you don't agree, you must not use the Service.
You must be at least 18 years old to create an account with Kitoya. When you register, you agree to provide accurate and complete information, and to keep it up to date.
You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. If you suspect unauthorized use of your account, notify us immediately at hello@kitoya.com.
We reserve the right to suspend or terminate your account, without prior notice, if you breach these Terms, engage in fraudulent activity, or otherwise misuse the Service.
Kitoya allows you to upload photos and details of your jersey collection ("User Content"). You retain full ownership of your User Content. By uploading it, you confirm that you own the rights to it, and you grant Kitoya a limited, non-exclusive license to store, display, and process this content solely for the purpose of operating the Service (including background removal via our image-processing providers).
We do not pre-screen User Content, but we reserve the right to remove any content that violates these Terms, at our discretion.
4.1 Subscription Plans. Kitoya offers a monthly and an annual subscription plan, with a 7-day free trial. Pricing is displayed in the app at the time of purchase.
4.2 Payment Processing. All payments are processed by RevenueCat, in conjunction with the Apple App Store or Google Play Store billing systems. Kitoya never collects or stores your payment card details directly.
4.3 Automatic Renewal. At the end of your free trial, your subscription will automatically renew and be charged according to the plan you selected, unless you cancel beforehand.
4.4 Cancellation. You may cancel your subscription at any time via your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period.
4.5 Refunds. Refund requests are handled directly by Apple or Google according to their own policies. We do not process refunds ourselves. Where applicable, French consumer law rights are unaffected by this clause.
4.6 Price Changes. We may change subscription prices from time to time, with reasonable advance notice. You may cancel before the new price takes effect if you disagree.
The Service, excluding User Content, including its design, features, and branding, is the exclusive property of Kitoya. You are granted a limited, non-exclusive, revocable license to use the Service for your personal, non-commercial use only.

Violation of these rules may result in immediate suspension or termination of your account.
Our collection and use of your personal data is described in our Privacy Policy. By using the Service, you agree to that processing.
The Service may link to third-party websites we do not own or control (such as the Apple App Store or Google Play). We are not responsible for the content or privacy practices of those third parties.
The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
To the fullest extent permitted by French law, Kitoya's total liability for any claim arising from your use of the Service will not exceed the amount you paid us in the 6 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
If a dispute arises, we encourage you to first contact us at hello@kitoya.com to seek an informal resolution. If the dispute is not resolved within 30 days, it may be submitted to arbitration in Paris, France, conducted in French, in accordance with French law. This does not affect any mandatory consumer protection rights you may have under EU law.
These Terms are governed by the laws of France, without regard to its conflict of law principles.

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
